I wonder how much of all this capitulation is due to the fascists seizing control of the courts, and the likelihood that they’ll face pro-fascist judgement?

I’ve been saying it for a decade. Once they own the courts it’s game over. They can decree the rule of law, and have the highest means of legitimizing it.
