Democrats on the Senate Judiciary Committee asked Chief Justice John Roberts in a new letter sent Thursday to take “appropriate steps” to ensure that Justice Samuel Alito recuse himself from any future legal disputes that might arise concerning pending congressional legislation that regulates the Supreme Court.
The trick is, when Alito says Congress didn’t create the Supreme Court, he’s not wrong.
The court was formed by the Constitution, just like the Legislative and Executive branches.
The problem is that there is no check and balance on court power. Yes, the Executive nominates judges and the Legislative confirms them.
Other than impeachment, there’s no other control over the court. It’s not like the Executive or Legislative can reverse a ruling they don’t like.
Changing the way the court works would involve either an Amendment, or a full blown Constitutional Convention, neither of which we have the political will to get done.
Congress has plenty of indirect power over the court, but congress is also the most broken part of the government and the reason why the supreme court feels illegitimate. The system is working as designed, the issue is that people have been voting against their own interest for decades. The fact we have to rely on the supreme court to legislate is the main problem.
