In a landmark ruling for the country, after rejecting claims that womanhood was preserved only for those who can bear children, the High Court of Andhra Pradesh ruled that trans women were “legally entitled” to recognition as women.

For a while now they’ve technically been recognizing hijra as third gender but not recognizing trans women in many places. There’s also some friction between people who identify with hijra and their historical practices and trans women which is seen as more western. I’ve talked to people about this before it’s quite different in many places in India on trans issues

Contrary to Western countries, there aren’t any ifs or buts, nor are there any exceptions or separate rules.

Just a pure and simple “trans women are women”. flag-trans-pride

Don’t worry, in a few years, SCOTUS will rule that trans women are fully legally women. This ruling will come 3 days after that *Handmaid’s Tale" Gilead law passes that prohibits women from having bank accounts. Trans women will be fully recognized as women…and immediately fall under the full control of their fathers or husbands.

I know I know but claiming womanhood is only for people who can have children excludes a lot of cis women and its endlessly satisfying transphobes can’t actually put a definition to it that excludes us but includes cis women.

What’s more fascist about India than any other place? Because they have a right winger in charge now?

This is the same as someone asking “How is the US fascist?”, and answering that with the wiki link to fascism.

Yes India has a right wing government. But if India is fascist so is America, Italy, Poland (new regime), the Netherlands (under Wilders), etc. Believe it or not, right wing governments can be a normal era in a democracy. The BJP is not making comments to annex other nations, tightening the rule of law, passing discriminatory policies, or abolishing elections or term limits. There is no democratic backsliding that has occurred in India because of the last 2 BJP terms, and Modi is going to step down after this term. After Modi, the BJP has no better candidate and the lefts/centrists will be back in power due to incumbency bias.

And all of this is normal in a democracy with multiple parties who can offer real choices to the people.
